NEW CHANGES TO MNAR FORMS SPECIAL CE CLASS

Are you aware of all of the changes coming on August 1st to the MNAR Forms, including a few statutory requirements? There are quite a few, not to mention some new lease forms.

This class is a complete look at the MNAR Purchase Agreement form and addenda. This is not your father's forms course! New this year are lease contracts, exclusive representation for consumers looking to rent, and lease listing forms. The instructors will not only walk you through the blanks, but will offer training on the challenges of working with renters and lessors. A must course if you plan to offer leasing services - not to mention an update on all of the changes! Don't be left out in the cold on all of the new rental forms!!!

RISK MANAGEMENT FOR
BROKERS AND MANAGERS

MNAR is pleased to present a special program designed for brokers and managers to help in the day-to-day management of your real estate brokerage. Today's marketplace is bringing many new challenges to brokers. We want to make sure you have all of the tools and information to adequately and properly supervise your agents. This program will help you manage risk and limit your exposure to liability.

Next month, the RMLS will be enhancing their service to include residential rental properties and the MNAR Forms Committee has developed new lease forms and contracts, due to be released next month. However, before you and your agents begin using these new tools, do you completely understand the forms and the work you will be expected to perform if you provide leasing services to consumers who want to rent? Within the past 45 days, we have conducted two hearings involving brokers and leasing issues resulting in significant consequences to the brokers! While the new forms and enhanced RMLS service might be a great opportunity to expand your services, we strongly encourage you to attend our special management program in September where we will identify information to help brokers and managers use MNAR forms as a risk management tool to manager their business and their client relationships effectively.

RISK MANAGEMENT FOR BROKERS AND MANAGERS will be presented on Thursday, September 9, 2010 at the Northland Inn in Brooklyn Park. The conference includes a two hour program presented by Paul Espinosa from Pearl & Associates and will include information to reduce risk in the area of seller and agency disclosure, record keeping, Fair Housing, Code of Ethics, copyright infringement and the need for an office risk management policy. It is practical, hands on information for a well run real estate office. (2 hours real estate and appraisal education credit pending.)

MNAR Legal Counsel Brad Boyd has a three hour program title, Forms as a Tool in the Broker's Risk Management Toolkit and it will identify the key 2010 MNAR form changes and revisions as well as sharing expertise needed when using the new forms relating to residential leasing. Brad will also give updates on the most common problems related to forms and contracts. This is a MUST COURSE for every broker! (3 hours real estate and appraisal education credit pending.)

New Forms Coming

  • Financing Addenda: Conventional or Privately Insured Conventional Mortgage, DVA Guaranteed Mortgage, FHA Insured Mortgage
  • Internet Display Options
  • Seller Facilitator Services Agreement
  • Seller's Property Disclosure Statement

In addition, the MNAR Forms Committee has also adopted 3 new forms pertaining to lease properties:

  • Contract for Exclusive Right to Represent Tenant
  • Exclusive Right to Lease Listing Contract
  • Residential Lease Agreement

The above forms will be available for download from www.mnrealtor.com on Friday, July 30, 2010.

The MNAR Forms Committee is still discussing changes to the title and examination language in the Purchase Agreement. The modification of this language will affect the following forms, which will have an effective date of September 1, 2010 and will available for download from www.mnrealtor.com on Wednesday, September 1, 2010:

  • Purchase Agreement
  • New Construction Purchase Agreement
  • Financing Addendum Seller's Contributions to Closing Costs and Discount Points (this form will be renamed: Seller's Contributions to Buyer's Costs Addendum)
  • Exclusive Right to Sell Listing Contract

MNAR partnering with LifeSource to promote organ, tissue donation
Seeking community stories from REALTORS®

MNAR is partnering with LifeSource, our state's organ and tissue donation agency, to encourage Minnesotans to register as organ and tissue donors.

You can help us by submitting your stories of donation and transplantation and by sharing information and resources about donation.

Working with tens of thousands of people each year to sell and purchase real estate, Minnesota REALTORS® develop relationships with individuals who will be applying for a new driver's license once they move. When Minnesotans apply for or renew their driver's license, they have an incredible opportunity to help others by registering to be an organ and tissue donor. It's as simple as checking the box on their driver's license application or registering online at www.DonateLifeMN.org.

With more than 2,600 Minnesotans waiting for a life-saving transplant, it is crucial that we encourage more of our neighbors to register as donors to provide hope and life to the people on the transplant waiting list. Dave's Story

For the past 20 months, Dave Costello has been waiting for a life-saving heart transplant. At the end of 2007, Dave was having trouble breathing. A trip to the doctor revealed an issue with his heartbeat, which doctors thought they could fix with a simple procedure. During the procedure a biopsy of his heart was performed, which later led Dave to receive a startling diagnosis. "The doctor called and told me that I had a rare disease that would significantly shorten my life," says Dave.

After going through months of testing and losing 50 pounds in six months, Dave was added to the national transplant waiting list in December of 2008. Here he waits in the company of more than 107,000 people across the country who are also waiting for their second chance at life. His wife of 32 years, Audrey, and his two children, David and Meggan, keep him grounded and focused on his health and healing. "Life is pretty normal now," says Dave. "But I do think about what the future may hold as I continue to wait for a transplant."

More than 2.3 million Minnesotans are registered as organ and tissue donors, about half of licensed drivers in the state. "I support organ and tissue donation not so that I can benefit from it," shares Dave, "but because it demonstrates sharing, caring, generosity and kindness and I believe in all of those."

Dave is a Commercial REALTOR® and owner of Costello & Associates, primarily serving tenants with their leasing and consulting needs. He is currently serving as a Director on the MNAR Board; Director of Second Chance for Life Foundation, a support group for people with heart problems through the University of Minnesota Medical Center; and a volunteer for LifeSource, sharing the message of donation with young people through driver's education and health classes.

In his spare time, Dave likes to live life to its fullest and enjoy time with his family and friends. "When I say 'live life to the fullest' I mean that each of us should enjoy today," he says, "because we don't know what tomorrow may hold."
